By engaging our services you agree to the terms set out below. These terms will cover all of our work with you in the future, unless a new agreement is made.

The scope of our work

  • We’ll invite a team of young creatives to attend a session, either in-person or online, to discuss and contribute their ideas, opinions and reviews relating to the brief that you give us. The group’s speciality is helping market to young audiences, including ideas for short-form social media videos. We’ll endeavour to put together a diverse group of young creatives with a range of expertise and interests. We’ll summarise the group’s output in a slide deck which we’ll aim to email to you within 30 days of the session.

  • Although we may make recommendations of suppliers including content creators, influencers and production companies in the course of our work, we don’t provide any of these services ourselves. We take no responsibility for the work of any suppliers that we recommend.

  • Our work is generally undertaken following a specific brief in which the ideas are tailored to fit, however in occasional cases we may send ideas to clients that are the same or similar to ideas we’ve sent to the same or different clients in the past. This is to be expected given the nature of digital marketing and reacting to audience trends, and will only be done when we believe the idea is a natural fit for the brief that was given.

Your use of the ideas

  • You’re granted permission to use the ideas we send you in whatever way you wish, in perpetuity, even if it’s for a different project than the one in the original brief.

  • The young creatives that we work with are freelance contractors, and we’re presenting to you the ideas that they supply to us. As the client you’re responsible for undertaking any due diligence before you use the ideas or act on recommendations from us, and we can’t compensate clients for any loss or harm resulting from ideas or recommendations that we provide. Any liability to us will be capped at twice the total rate for the project.

Confidentiality

  • If any part of your brief should be treated as confidential this must be specified in advance of the session taking place. All our participants and contractors have signed a confidentiality agreement, but you’re welcome to supply a specific NDA for them to sign if necessary.

  • Unless specifically agreed otherwise in writing in advance of the session taking place:

    • You’re free to disclose publicly that we’ve worked for you, including details of the work that we did.

    • When we send you the output slide deck you’re free to share it with whoever you wish, although we request your sensitivity if the deck includes any contact details or rates for other suppliers. You are not entitled to name participants publicly without their consent.

    • If we share with you a written transcript or an audio or video recording of the session, you may share this internally (eg. with your colleagues or contractors) but not publicly.

    • You agree not to disclose the amount that you pay for our service or the details of any negotiation.

    • We reserve the right to publicly disclose the fact that we’ve worked for you, including a brief summary of the project that you engaged us to work on.

    • If you use any of the ideas or recommendations we send you, we reserve the right to acknowledge this publicly and refer to it in our marketing and PR material.

  • The output slide deck and the transcripts or recordings of our work for you may be worked on or viewed by various people within our business including freelance contractors, but won’t be shared publicly or sent to anyone outside our business within 1 year of you being sent it unless you grant us permission to share it.

  • We are not obliged to provide you with the names or contact details for any of our participants, the amount that they’re paid, or any details about the inner workings of our business that may compromise our professional position or that of our partners or participants.


Payment terms

  • Alongside sending you these terms we’ll agree a fee for the sessions you’d like to book with us. To allow for swift processing we’ll aim to send an invoice for the agreed fee before the session takes place, and you agree to process the payment within 30 days of receiving the output slide deck from us after the session.

  • You do not have our permission to use any of the ideas or recommendations that we send you unless you’ve paid in full. If you need to implement ideas quickly you may choose to pay upfront to avoid delays.

  • In some cases we may require payment of part of the fee upfront before the session takes place or before we supply the output slide deck, which we’ll let you know in advance of the session taking place.

  • What happens if WE need to cancel: If the session can’t go ahead or we feel that we cannot deliver our services to you for any reason, our invoice for that session will be void and any upfront payments you’ve made will be refunded within 30 days. There will be no further liability.

  • What happens if YOU need to cancel: If you choose to cancel after confirming in writing that you’ll engage our services for a specific session, including you having agreed on a fee for the work and having been sent these terms, we’ll be entitled to charge a cancellation fee. This amount will be up to 100% of the agreed fee for cancellations within 48 hours of the start of the session taking place, or up to 50% of the agreed fee for cancellations within 12 working days of the start of the session taking place.

Recruitment referrals

  • If we introduce you to any lemontank participants and you choose to hire them into any freelance or contract roles, we’ll be entitled to charge an introduction fee.

Safe spaces

All our sessions and the related communications in the course of our work should be inclusive and supportive spaces, with no tolerance for abusive behaviours including:

  • Personal insults or aggression towards an individual. 

  • Oppressive language or discriminatory actions including racism, sexism, ableism, misogyny, transphobia, homophobia, misgendering, islamophobia and antisemitism. 

  • Verbal or written harassment, for example repeated uninvited personal comments. 

  • Physical abuse or violence.

Everyone’s free to call out this behaviour if they encounter it, and we’ll all be ready to listen and learn if people feel harmed by it. We may choose to terminate our work with a client if we feel that they or anyone on their team has acted inappropriately.
